Hypic US Privacy Policy

Introduction

This privacy policy ("Privacy Policy") applies to the personal information of US users and other US individuals that Hypic processes in connection with Hypic applications, software and related services that link to or reference this Privacy Policy. The Platform is operated by TikTok USDS Joint Venture LLC (“we”, “us”, or “our”).

What Information We Collect

We collect your information in three ways: Information You Provide, Automatically Collected Information, and Information From Other Sources. More detail is provided below.

Information You Provide

• Account Information. We collect information that you provide to us, such as your date of birth when you set up an account.
• User Content. We may collect the content you create, import, upload, or generate through the Platform, including associated metadata (such as when, where, and by whom the content was created). User Content may include the photographs and images you upload and the prompts, files, and other types of information that you submit to our AI-powered interfaces, as well as the responses they generate. We may collect User Content through pre-uploading at the time of creation, import, or upload, regardless of whether you choose to save or publish that User Content, for example, to provide personalized recommendations. Additionally, we also access content (such as text, images) from your device's clipboard if you choose to copy and paste content to or from the Platform or share content between it and a third party platform.
• Marketing and Research Information. We collect information you choose to provide, such as your gender, age, and preferences, if you choose to participate in a survey, research, promotion, contest, marketing campaign, or event conducted or sponsored by us.
• Communication Information. When you contact or otherwise communicate with us, we collect the information you send us, such as proof of identity or age, your data subject requests, and feedback or inquiries about your use of the Platform.

Automatically Collected Information

• Technical Information. We automatically collect certain device, browser, and network information when you use the Platform. This information includes your IP addresses, device model, operating systems, network types and connections, device identifiers, application versions, device resolutions, system languages and regions, and battery related information. We also collect service-related, diagnostic, and performance information, including crash reports and performance logs. Where you log-in from multiple devices, we may be able to use your account information to identify your activities across those devices.
• Location Information. We automatically collect information about your approximate location (e.g., country, state, or city), including information based on your SIM card regions and IP addresses.
• Usage Information. We collect information about how you interact with the Platform, including information about the content you view, how you choose to edit images, problems encountered, the duration and frequency of your use, and the settings you apply.
• Image Information. We may collect information about the images that are a part of your User Content, such as identifying the objects and scenery that appear and the existence and location within an image of face and body features and attributes. We may collect this information, for example, to enable image editing and effects features. Any images we collect to provide these features will be deleted promptly after we provide the said features that use face information and not retained. We do not use any face or body information to identify you or other people in your content, and we do not share such information with third parties.
• Cookies. “Cookies” are small files which, when placed on your device, enable us to collect certain information from you to provide certain features and functionality. Depending on the jurisdiction from which you access the Platform, we and our service providers and business partners may use cookies and similar tracking technologies to operate and provide the Platform, including functions such as remembering your language preference, measuring website traffic, performance and functionality, for security purposes, and for marketing purposes.

Information From Other Sources

• Third-Party Platforms. We receive information from third party platforms to provide you with certain integrations and features. For example, we may receive your username, email address, and profile picture, as well as certain technical information, if you sign up or log in to the Platform using a third-party platform.
• Our Corporate Group. We may obtain information about you from affiliates controlled by, or under common control with, us.
• Others. We may also collect or receive information about you from others, including government authorities and publicly-available sources, as well as other users, such as where you are mentioned in User Content or in a complaint, request or feedback submitted by a user or third party.

How We Use Your Information

We use your information to operate, provide, develop, and improve the Platform, including for the following purposes:

• Operate, customize, and administer the Platform, such as enabling you to create, modify, share, and consume User Content.
• Enforce our Terms of Service and other conditions and policies that apply to you, and to protect the safety of our community and integrity of the Platform, including by scanning, analyzing, and reviewing User Content.
• Communicate with you about service-related matters and updates, and respond to your requests and feedback.
• Provide you with user support, including responding to, handling, and processing queries, requests, complaints, and feedback from you.
• Maintain and enhance the safety, security, and stability of the Platform by identifying and addressing technical or security issues or problems (such as technical bugs and spam accounts) and detecting abuse, fraud, and illegal activity).
• Review, support, improve, and develop the Platform, and train, test, and improve technology, such as machine learning models and algorithms, including by analyzing how people are using the Platform; conducting research; developing new features; monitoring your activity and usage across the devices you use to access the Platform; and scanning, analyzing, and reviewing User Content.
• Facilitate the provision of third party features or services that are integrated with the Platform, like content sharing at your request.
• Promote the Platform or third party services through marketing, contests, or campaigns, and advertising through third-party advertising platforms.
• Comply with our legal obligations and defend our legal rights and commercial interests, and those of our affiliates, users, and the public; and
• Aggregate or de-identify Information We Collect.

How We Share Your Information
This section sets out how we may share your information with service providers and other partners, which may be located outside of your country. Please note that information shared with certain third parties may be processed in accordance with their privacy policies.
Service Providers and Business Partners

We share your information with service providers and business partners as necessary to help us perform business operations and for business purposes, including providing, supporting, and developing the Platform cloud hosting, content delivery, analytics, and customer and technical support.
We also share information with TT Commerce & Global Services LLC and its affiliates (“TT Commerce & Global Services”) to facilitate a global and interoperable experience, and for other permitted business purposes. We only share specific categories of information consistent with applicable law, including Executive Order 14352 and any compliance obligations thereunder.
Our Corporate Group
We may share “What Information We Collect” with affiliates controlled by, or under common control with, us as necessary for the purposes set forth within this Privacy Policy.

In Connection with a Sale, Merger, or Other Business Transfer

We may also share your information in connection with, or during negotiations of, a corporate transaction, such as a merger, consolidation, sale of assets or shares, reorganization, financing,acquisition of all or a part of our business, or in the unlikely event of bankruptcy.

Legal Obligations and Rights

We may share the information described in "What Information We Collect" with competent law enforcement, regulatory, or government agencies, courts, or other third parties if we have a good faith belief that it is necessary to:

• comply with a legal obligation;
• lawfully protect the rights, property, safety and security of our users, copyright holders, and others;
• investigate potential violations of and enforce our Terms of Service, and other policies; or
• detect, investigate, and prevent fraud, technical issues, copyright infringement, or other misleading or illegal activities.

Others

We may also share certain information with related products and services which share account log-in features and other functionalities.

With Your Consent

We may share information with third parties with your consent or at your direction.

Your Rights and Choices
You are entitled to certain rights depending on where you live. We will not retaliate against you for exercising your rights, although doing so may impact the Platform's available features and functionalities.
Your Rights. You may submit a request to know, access, correct or delete the information we have collected from or about you by contacting us using the contact methods in the “Contact Us” section. You may also have the right to appeal any decision we have made about your request through these same methods. California residents may also be entitled to obtain information about personal information that we shared, if any, with other businesses for their own direct marketing uses. You may exercise these rights by submitting your request using the contact methods in the “Contact Us” section.
We will respond to your request consistent with applicable law and subject to proper verification. We will verify your request by asking you to send it from the email address associated with your account or to provide information necessary to verify your account.
Authorized Agents. You may be entitled, in accordance with applicable law, to submit a request through an authorized agent. To designate an authorized agent to exercise choices on your behalf, please provide evidence that you have given such agent power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf.
Opt-Out of Sale and Sharing. The Platform does not sell your personal information or share your personal information with third parties for purposes of cross-context behavioral advertising or targeted advertising where restricted by applicable law. Please note that the Platform does not currently support “Do Not Track” requests.
Sensitive Personal Information. Information You Provide may constitute sensitive personal information under applicable state privacy laws, such as any sensitive information you choose to disclose in survey responses or in your User Content, we only process such information in order to provide the Platform and within other exemptions under applicable law.
Profiling. We do not engage in profiling which results in legal or similarly significant effects, as defined under applicable law.
Your Choices. If you have registered for an account, you may also access, review, and update certain personal information that you have provided to us by logging into your account and using available features and functionalities. If you choose to log-in, sign-up, or link to a third-party service, such as Apple, Facebook, or TikTok, you may be able to manage the type of data shared with Hypic through that service’s settings.
You can also refuse, disable, and/or delete cookies and similar tracking technologies that collect your information through your device or browser settings, though by doing so, some of the Platforms’ features and functionalities may no longer be available to you. Each browser and device is different, so please consult the instructions provided by your browser or device (as applicable) to modify your cookie settings.
You can also opt out of marketing or advertising emails by using the “unsubscribe” link or mechanism noted in each marketing or advertising emails.

Data Security
We maintain technical, administrative, and organizational measures designed to protect your information from unauthorized access, theft, disclosure, modification, or loss, and to provide a level of security appropriate to processing risk.
The Platform may contain links, functionality, and content maintained by third parties we do not control, and any information shared with such third parties will be subject to their privacy and security practices and terms of use. We are not responsible for, and make no representations regarding, such third party practices and policies.

Data Retention
We retain information for as long as necessary to provide the Platform and for the other purposes set out in this Privacy Policy. We may also retain information when necessary to comply with contractual and legal obligations, when we have a legitimate business interest to do so (such as improving and developing the Platform, and enhancing its safety, security and stability), and for the exercise or defense of legal claims.
The retention periods differ depending on the type of information and the purposes for which we use the information. For example, when we process your information to provide you with the Platform, we keep this information for as long as you have an account. This information includes your profile and User Content. If you violate our Terms, we may keep your information as is necessary to process the violation and as long as permitted by applicable law.

Information Relating to Children

Hypic is not directed at, and may not be used by, children under the age of 13. If you believe that we have collected personal information from a child under the minimum age, please contact us using the contact information found in the “Contact Us” section below.
Privacy Policy Updates

We may amend or update this Privacy Policy from time to time. We will notify you of any material changes by updating the “Last Updated” date at the top of the new Privacy Policy or providing any other notice as required by applicable law. We recommend that you review this Privacy Policy from time to time to stay informed of our privacy practices.
